Validate a European patent in Spain

Update date: 06/05/13

European patents are handled at the European Office till the grant. Once published the concession, the European patent holders have three months to validate the concession in countries signatories of the European patent where they want to have effective protection. No validation of the patent in a country, the holder has no patent rights in that country. The question is, how do you validate a European patent in Spain?

To validate a European patent, the whole patent document (description and claims) must be translated integrally Spain  into Spanish before being deposited in the OEPM (Spanish Office of Patents and Trademarks). In case that the European patent applicant not resides in Spain he needs the representation of an Spanish Industrial Property Agent, as Volartpons, to perform the validation.
